Part II – What is the future of old cases filed prior to Feb. 1, 2014?

Former Judge Mike McGivern and Attorney Bob Burke argued on behalf of the Court of Existing Claims, and asked the Supreme Court to appoint Judge Margaret Bomhoff as a special judge to preside over the CEC as a temporary measure until the legislature later authorizes a judge for the CEC.

In the alternative, they requested that the Supreme Court declare that Judge Bomhoff is a state officer who, according to Art. 23, Sec. 10 of the Oklahoma Constitution, shall continue to serve until her successor is duly qualified.

WITHOUT A JUDGE, none of the orders under the old law of either the Workers’ Comp Court or the CEC can be enforced.
